Terms of Service

1. Acceptance of Terms
By accessing or using FrameFlow ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and FrameFlow ("we", "our", or "us"). We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Service
FrameFlow is a photographer gallery delivery platform that enables professional photographers to securely share, deliver, and manage client photo galleries online. Features include private gallery links, PIN-protected access, download controls, client favouriting, and subscription-based storage.
3. User Accounts and Responsibilities
3.1 Account Registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential.
3.2 Account Security
You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access. We are not liable for any loss resulting from unauthorised use of your account.
3.3 Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
4. Subscription, Billing, and Cancellation
4.1 Free Trial
New accounts receive a 7-day free trial with full access to the Service. No payment is required during the trial period. At the end of the trial, continued access requires an active subscription.
4.2 Paid Subscriptions
Subscriptions are available on a monthly or yearly billing cycle. Prices are listed on our pricing page and are subject to change with reasonable notice.
4.3 Billing
Payments are processed by our payment provider (Stripe). By providing payment information, you authorise us to charge the applicable subscription fee on a recurring basis until you cancel.
4.4 Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access until then. We do not offer prorated refunds for unused time, except where required by applicable law.
4.5 Failed Payments
If a payment fails, we may suspend access to the Service until the outstanding amount is settled.
5. Acceptable Use
You agree not to use the Service to:
- Upload, share, or store illegal, harmful, defamatory, or obscene content
- Infringe the intellectual property rights of any third party
- Distribute malware or engage in phishing or fraud
- Attempt to gain unauthorised access to any system or network
- Resell or sublicense the Service without our prior written consent
- Use the Service in any way that violates applicable law or regulation
You (the photographer) are responsible for the personal data of your clients that you upload or share through the Service. You must have an appropriate legal basis (such as consent or a contract) to process that data, and you must comply with applicable data protection laws, including the GDPR.
6. Intellectual Property
6.1 Your Content
You retain all intellectual property rights to the photos and content you upload to the Service. By uploading content, you grant FrameFlow a limited, non-exclusive, royalty-free licence to store, process, and display your content solely to provide the Service to you.
6.2 Our Platform
All other intellectual property in the Service — including software, design, trademarks, and documentation — is owned by FrameFlow or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our prior written consent.
7. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Service is provided "as is" without warranties of any kind, express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or free from data loss.
- Our total liability for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, consequential, or special damages, including loss of data or loss of profits, even if we were advised of the possibility of such damages.
Nothing in these Terms limits our liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded by law.
8. Termination
8.1 By You
You may delete your account at any time from your account settings. Upon deletion, your galleries and uploaded content will be permanently removed in accordance with our Privacy Policy.
8.2 By Us
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. We will provide reasonable notice where possible.
8.3 Effect of Termination
Upon termination, your right to use the Service ends immediately. Sections 6, 7, 9, and 10 survive termination.
9. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands, unless mandatory consumer-protection laws in your country of residence require otherwise.
